1. Overview
This Refund Policy applies to all purchases of software, scripts, platform components, and related products (“Software”) from Aron and Sharon, trading as Online Casino Script (KVK: 62745115), through our website at onlinecasinoscript.com.
By completing a purchase, you acknowledge that you have read and agreed to this Refund Policy.
2. Digital Products — Right of Withdrawal
Our Software constitutes digital content that is not supplied on a tangible medium. In accordance with Article 6:230p of the Dutch Civil Code (implementing Article 16(m) of the EU Consumer Rights Directive 2011/83/EU), the right of withdrawal does not apply to digital content once delivery has begun, provided that:
- You have given prior express consent for delivery to begin before the withdrawal period has ended;
- You have acknowledged that you thereby lose your right of withdrawal.
By completing a purchase and receiving access to the Software (via download link, repository access, or other delivery method), you expressly consent to immediate delivery and acknowledge that you lose your right of withdrawal.
3. B2B Transactions
Our Software is sold exclusively on a business-to-business (B2B) basis. The EU Consumer Rights Directive and the Dutch consumer protection provisions (Title 5, Section 2b of Book 6 of the Dutch Civil Code) apply only to consumers. As a business purchaser, you do not have statutory consumer withdrawal rights.
4. No Refunds — General Policy
All sales are final. We do not offer refunds on delivered Software. This includes situations where:
- You change your mind after purchase;
- You did not read the product description, documentation, or system requirements before purchase;
- The Software does not meet your expectations that were not part of the product description;
- You are unable to obtain a gambling license in your jurisdiction;
- Your gambling license is suspended or revoked;
- Regulatory changes in your jurisdiction make the use of the Software impractical;
- You lack the technical skills or infrastructure to install, configure, or operate the Software;
- You purchased the wrong product.
5. Exceptions
We may, at our sole discretion, consider a refund or partial refund in the following limited circumstances:
5.1 Non-Delivery
If you do not receive the Software within 48 hours of confirmed payment and we are unable to resolve the delivery issue within a further 7 business days, you may be eligible for a full refund.
5.2 Materially Defective Product
If the Software is materially defective — meaning it does not contain the core features as described in the product listing at the time of purchase — and we are unable to remedy the defect within 30 days of your written notification, you may be eligible for a refund. Minor bugs, cosmetic issues, or features not explicitly listed in the product description do not constitute material defects.
5.3 Duplicate Payment
If you are charged more than once for the same product due to a payment processing error, we will refund the duplicate charge promptly.
6. How to Request a Refund
If you believe you are eligible for a refund under Section 5, you must:
- Contact us at [insert email address] within 14 days of the purchase date;
- Provide your order number, payment confirmation, and a detailed description of the issue;
- Allow us up to 14 business days to investigate and respond.
Approved refunds will be processed using the original payment method where possible. For cryptocurrency payments, refunds (if approved) will be issued in the cryptocurrency originally used, at the exchange rate at the time of the refund.
7. Termination and Refunds
If your License is terminated by us due to a breach of our Terms of Service (including operating without a valid Gambling License, targeting the Netherlands, or any other material breach), no refund will be provided.
If your License is terminated by us for reasons unrelated to any breach on your part, we may, at our discretion, offer a pro-rata refund for any unused prepaid period of subscription-based products.
8. Chargebacks
Initiating a chargeback or payment dispute without first contacting us to resolve the issue constitutes a breach of these Terms. We reserve the right to suspend or permanently revoke your License, restrict your access to our website and services, and pursue recovery of any losses incurred.
9. Modifications
We reserve the right to modify this Refund Policy at any time. Changes will be posted on our website. The Refund Policy in effect at the time of your purchase will apply to that transaction.
